It shall be the policyholders responsibility to ensure that their policy of insurance covers the circumstances giving rise to the claim, if not covered they will be responsible for any costs incurred.

Where appropriate and where instructed by the policyholder to take all necessary steps on an emergency basis to mitigate the loss arising from the claim. Such costs will be payable by the policyholder directly to the supplier. Major Loss will attempt to recover some or all of these costs on the policyholder’s behalf from the insurer.

If payment/settlement is made to the policyholder directly they must inform Major Loss within 48 hours of receipt and pay all fees as defined in here and agreed on the mandate within a further 48 hours together with any costs, expenses, disbursements professional fees associated with the claim.

Major Loss reserves the right without prejudice to its other rights under this Agreement to charge reasonable fees to the policyholder to reflect its loss, if any of the terms of the mandate are materially breached by the policyholder, or if Major Loss is prevented by them from performing its obligations. These fees would usually be 10% of the current claim settlement value being negotiated plus all costs, expenses, disbursements and professional fees associated with the claim.
